Riney Palter Secures Affirmation of Judgment in Wrongful Termination Case

Theodore J. Riney, Bruce K. Packard and James O. Crewse recently affirmed the trial court’s summary judgment on behalf of Holiday Hospitality Franchising Inc. and Six Continents Hotels, Inc. dismissing the plaintiffs’ claims for wrongful termination, intentional infliction of emotional distress, and employment retaliation. The Court of Appeals found that the evidence did not rise to a level that would "enable a reasonable and fair-minded people to differ in their conclusions," that no genuine issue of material fact existed and affirmed the judgment.

Riney Palter Obtains Verdict in Breach of Contract Case

John T. Palter and Kimberly M. J. Sims secured a directed verdict in favor of PriceKubecka, PLLC and against plaintiff on claims to the equity in PriceKubecka and affirmed its summary judgment on plaintiff’s claims for fraud, negligent misrepresentation and quantum merit. This matter is currently pending appeal.

Riney Palter Obtains Reversal of Arbitration Award in Accounting Dispute Case

John T. Palter, Bruce K. Packard and Kimberly M. J. Sims reversed of a portion of an arbitration award denying Townes Telecommunications Inc. its attorney’s fees and costs. The Court of Appeals Fifth District of Texas vacated that portion of the award, and otherwise affirmed the arbitration award in favor of Townes Telecommunication. The application for writ to the Texas Supreme Court was denied.

Riney Palter Secures Take-Nothing Judgment for Fortune Dynamic, Inc. in Intellectual Property Case

John T. Palter, Theodore J. Riney and Bruce K. Packard recently affirmed a Take-Nothing Judgment on behalf of Fortune Dynamics Inc. by the U.S. Court of Appeals for the Federal Circuit against Fortune, an importer and wholesaler of women's footwear. Bernardo Footwear, LLP filed a claim alleging patent infringement on a specific sandal design. The Court ruled that plaintiff failed to satisfy the ordinary observer test and therefore, was not entitled to any of the relief it sought against Fortune.

Riney Palter and McCullogh & Associates Net Award for Covenant Capital in Texas Stock-Scam Case

Riney Palter and McCullogh & Associates, La Jolla, California, recently secured a judgment on behalf of Covenant Capital Partners in a Texas stock-scam lawsuit stemming from false claims about patent ownership in investor offering materials. The defendants, Soil Servers, Inc., and its CEO, Larry Johnson, were ordered to pay the investors’ fees and costs associated with the case.

Riney Palter Obtains Verdict in Teacher Abuse Case

Theodore J. Riney and Kimberly M. J. Sims recently secured a verdict in Dallas County District Court in favor of Mary Oliver, the Dallas Independent School District teacher who was severely beaten in her classroom by another teacher. The jury in the case awarded Ms. Oliver actual and punitive damages as the result of the assault.
